These Terms of Service ("Terms") govern your use of the Nine VPN mobile application ("the App", "we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) and legally able to enter into these Terms. If you use the App on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.
Nine VPN provides a virtual private network (VPN) that encrypts your internet connection and routes it through servers we or our providers operate. The App also offers optional features such as server selection, in-app rewards, and an ad-free subscription. We may add, modify, or discontinue features at any time.
You agree not to use the App to:
We may suspend or terminate access if we reasonably believe you have violated these Terms.
The App is free to use and supported by advertising for non-subscribers. By using the free tier you agree that ads (including banner, interstitial, app-open, and rewarded ads) may be shown. Some features may require watching a rewarded ad or may be time-limited.
The App, including its software, design, logos, and content, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, reverse-engineer, decompile, or create derivative works except as permitted by law.
Your use of the App is also governed by our Privacy Policy, which describes how we handle information. Please review it carefully.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that any particular server or speed will be available. A VPN reduces certain risks but does not guarantee complete anonymity or security.
To the maximum extent permitted by law, we and our providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD 25.
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising out of your use of the App or your violation of these Terms or applicable law.
You may stop using the App at any time by uninstalling it. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or for operational or legal reasons. Sections that by their nature should survive termination (e.g. Sections 6, 8, 9, 10) will survive.
We may update these Terms from time to time. We will update the "Last updated" date above and, where appropriate, provide an in-app notice. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the jurisdiction in which the App's publisher is established, without regard to conflict-of-law rules. Disputes will be subject to the competent courts of that jurisdiction, unless mandatory local consumer law provides otherwise.
